Generally speaking, try to avoid repeating yourself. You mention pornographic material (as well as some other things) in more than one point. I would also try to break point 8 into a bullet list or something, to make it clearer.

Your TOS seems OK, although you do seem to have a strong emphasis on hacking/cracking/warez Smile. One thing you may not be aware of, is that 95% uptime actually means up to 36 hours of downtime per month...

That's roughly 7 hours of downtime, which is more reasonable Smile. However 99.5% is what most hosts offer (3.5 hours of downtime).

Of course the majority of these other hosts are on server with multiple proper internet connections where if one provider goes down another can kick in.
